1. The MarketHub online shop (the “Shop”) operates at markethub.pl/sklep, and its English version at markethub.pl/en/market-scan/. In the Shop we sell access to reports, e-books, online courses and other digital content and services.
2. The Shop is run by MarketHub sp. z o.o., based in Kraków, Poland (the “Seller”).
3. These Terms apply to both consumers and businesses. They set out the rules for using the Shop and for concluding distance contracts.
2. Definitions
3. Contacting the Seller
4. Technical requirements
To use the Shop and place orders you need:
5. General information
1. You do not need an Account to browse the Shop. You can place an order with or without an Account. Products made available online (e.g. courses) require an Account.
2. In the English version of the Shop, prices are given in euro (EUR) as net prices. VAT is added at the applicable rate, and the gross amount is shown in the Cart before payment. Businesses from other EU countries with a valid VAT number pay no Polish VAT (reverse charge); neither do businesses from outside the EU that give their tax ID.
3. Whenever we reduce a price, we also show the lowest price of the Product in the 30 days before the reduction.
4. The Seller is not liable for interruptions in the Shop’s operation caused by force majeure, unlawful acts of third parties or the Shop’s incompatibility with the Customer’s technical infrastructure. This does not limit consumers’ statutory rights.
6. Shop account
1. You create an Account when placing an order or via the registration form. Creating and keeping an Account is free of charge.
2. You can delete your Account at any time by writing to marketing@markethub.pl.
3. We process the data you give in the Shop in accordance with our Privacy policy. You can ask for access to it at any time.
7. Placing orders
1. To place an order, add Products to the Cart, enter the recipient and invoice details, choose a payment method and accept these Terms.
2. For some Products you can choose a one-off or recurring payment (monthly or annual). The Product description also sets out the scope and duration of the licence to use it.
3. After you place an order, we send you an email confirming that we have received and accepted it. The Contract is concluded when you receive this email.
8. Payment and delivery of Products
1. You pay for your order through Przelewy24 (PayPro S.A.), choosing one of the methods it offers, or by bank transfer to the Seller’s account if the Shop offers this option. We do not accept cash.
2. Payment through Przelewy24 is made immediately while placing the order.
3. We deliver digital content by email, as a download link sent to the address given in the order, or make it available in your Account after you log in. The delivery time depends on the type of Product:
a) a Ready Product is delivered straight after the payment is booked;
b) a Made-to-order Product is delivered within 3 Business days after the payment is booked.
We show the type of Product and the delivery time (for a Made-to-order Product: the exact date) on the Product page, in the Cart before you place the order, and in the order confirmation. If the Product description gives a different date, that date applies.
4. If we do not deliver a Made-to-order Product on time, write to us. A consumer and a business with consumer rights may then call on us to deliver the Product, and if we do not deliver it immediately or within an additional period they set, they may withdraw from the Contract (Article 43j of the Polish Consumer Rights Act).
5. You can use the Products from anywhere with internet access.
6. PDF reports, including market scans, are sold under a licence for one person: the person who placed the order. The licence is non-exclusive, perpetual and non-transferable. You may read and print the file and use the information in it for your own purposes, including in your work. You may not share the file or any part of it with other people, including colleagues at the same company, publish it, resell it or place it where other people can access it. This does not limit the statutory right to quote.
9. Withdrawal from the contract
1. A consumer and a business with consumer rights may withdraw from a distance Contract within 14 days without giving a reason. The period runs from the day the Contract is concluded.
2. To withdraw, send us a statement, e.g. by email to marketing@markethub.pl. It is enough to send it before the period expires.
3. We refund the payment within 14 days of receiving the statement, using the same payment method as for the order, unless you agree to another.
4. The right of withdrawal does not apply to digital content not supplied on a tangible medium if we began supplying it with your express prior consent, after informing you that you would lose the right of withdrawal and after you acknowledged this, and we sent you confirmation of the Contract (Article 38(1)(13) of the Polish Consumer Rights Act). You give this consent and acknowledgement when placing the order.
5. For a Made-to-order Product you may withdraw from the Contract at any time until the file is delivered, without giving a reason, and get a full refund. The consent described in point 4 does not take this right away: you lose it only once the file is delivered. This right applies to every Customer, including businesses. Send the statement as described in point 2; we refund the payment as described in point 3.
6. Nor does the right of withdrawal apply to services we have fully performed with your express prior consent, if before starting the service we informed you that you would lose the right of withdrawal once it was performed and received your acknowledgement of this (Article 38(1)(1) of the Polish Consumer Rights Act).
10. Complaints
1. We are liable to consumers and businesses with consumer rights for the Product’s conformity with the contract under the Polish Consumer Rights Act. If digital content does not conform with the contract, you can demand that it be brought into conformity and, in the cases set out in the Act, a price reduction or withdrawal from the contract.
2. Towards other businesses, liability under the statutory warranty for defects is excluded to the extent permitted by law.
3. Submit a complaint by email to marketing@markethub.pl or in writing to the Seller’s address. Ideally, describe the problem, give the date it occurred, your details and what you expect.
4. We respond to a complaint within 14 days of receiving it. If you are a consumer or a business with consumer rights and we do not respond within this period, we consider the complaint justified.
5. We do our best to make sure our reports and training courses (including on research, company verification, open-source intelligence and Google hacking) meet your expectations. However, a complaint cannot be based solely on a subjective assessment of the content’s usefulness or on the fact that you already knew some of it, if the Product matches its description and programme.
11. Out-of-court dispute resolution
A consumer may use out-of-court complaint and redress procedures. In particular, a consumer may:

12. Personal data
1. The controller of Customers’ personal data is MarketHub sp. z o.o.
2. We process data to conclude and perform the Contract, issue an invoice and handle complaints and, if you consent, for marketing purposes.
3. When you pay through Przelewy24, we pass the necessary data to the payment operator, PayPro S.A.
4. Providing data is voluntary, but without the data needed to conclude the Contract we cannot conclude it.
5. The detailed rules and your rights are described in our Privacy policy.
13. Final provisions
1. Contracts in the Shop are concluded in Polish. This English version of the Terms is a translation; in case of discrepancies, the Polish version prevails.
2. We may change these Terms for important reasons, e.g. changes in the law or in payment and delivery methods. We announce any change at least 7 days before it takes effect. Orders placed earlier are governed by the previous version.
3. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code, the Consumer Rights Act, the Act on Providing Electronic Services and the GDPR. For consumers living in another EU country, this choice of law does not remove the protection given to them by the mandatory provisions of the law of their country.
4. These Terms do not exclude or limit the rights of consumers and businesses with consumer rights under mandatory provisions of law.
